Donuts Inc., one of the largest portfolio applicants of new gTLDs, has launched a brand new domain-blocking program designed to help companies protect their brands and IP rights. DPML stands for Domains Protected Marks List. The DPML program prevents cybersquatting by allowing brand and trademark owners to block all second level registrations across all Donuts TLDs with one trademark submission! DPML protects trademark holders at a fraction of what it would cost to defensively register all Donuts TLDs individually. Donuts has applied for over 300 new gTLDs and is estimating to open over 200 new gTLDs.

An Early Access Program, or EAP for short, typically replaces the traditional Landrush period for Top-Level-Domain introductions. Like the Landrush period, the EAP makes available domain names to all entities that may not own a trademark for the name they wish to register or for high value domain names that the respective registry reserves.

==Overview==
DPML Applications can be submitted directly through HEXONET. Prior to submitting a DPML Application, the trademark holder must first register a mark with the Trademark Clearinghouse (TMCH), a service that HEXONET also provides. The mark must be registered according to the "use" standard, which is the same standard for registration during the Sunrise period. Once the TMCH has validated a mark, a SMD File (signed mark data file) will be issued, which can be used to submit a DPML Application. Each DPML Application must (i) include one or more SMD files corresponding to the applied-for label(s) and (ii) meet the qualifications specified by ICANN and detailed in the TMCH Guidelines (may change from time to time). Once the DPML subscription is complete, the trademark term is blocked from registration in all Donuts' TLDs for an initial period of five years. It is important to remember that a block is not a registered domain. Therefore, it cannot be used for a website or for email, and it does not resolve.

The EAP process was first pioneered by Donuts and is now used by a number of other registries like Google Registry. The program involves a number of consecutive days, typically seven (7), in which there is a set price for a domain name on each of the days. The price drops on each consecutive day until the 5th, 6th and 7th day, where the price remains the same. The set price for each day depends on the domain name and typically a grouping determined by the registry. Here is an example:

Purchase of a domain during the EAP phase is First-Come, First-Served. The premium price paid by a registrant is typically only one-time and the domain name is renewed at regular standard prices. This one-time pricing model may change at anytime and may depend on the registry running the EAP program.

==Benefits of Preorder EAP==

'''Are there any exclusions?'''
+
* Plan and target desired domain names well in advance of any EAP date.
+
* HEXONET system automatically attempts to register preordered domains within a second of the respective EAP phase opening.
+
* Successful EAP registration costs are automatically deducted from the user's reserved funds balance.
+
* Failed EAP registrations are automatically refunded to the user's account balance

Previously Registered Domains: A term will not be blocked in any TLD where that term is already registered as a domain. If a domain is initially excluded from DPML because it is already registered, a rights holder may still subscribe to DPML (and block the term in all other Donuts TLDs). If the previously registered domain expires or is deleted, DPML protection will then automatically apply to that TLD.
+
== General FAQs ==

+
Premium Domains: In Donuts TLDs, most domains are priced as standard. However there are a limited number of higher-priced premium names. DPML blocks terms for standard priced names only.
+

+
Other Sunrise Rights: Another trademark holder with Sunrise rights for a term may register that term as a domain name, even when a DPML subscription exists for it. This is known as a “DPML Override”.
+

+
'''What is a DPML Override?'''
+

+
A DPML block on a specific domain may be overridden and the domain registered by a mark owner with Sunrise rights to the applicable domain (a “DPML Override“). A DPML Override can be performed at any time and can be initiated by a mark holder of the DPML blocked term. The party performing an DPML Override must have an exact match, Sunrise-eligible trademark for the domain (i.e., the overriding party must have a valid SMD File issued by the TMCH).
+

+
'''Is there Whois output for DPML?'''
+
Yes, the Whois output identifies the DPML block holder for the blocked domain and states that the domain is blocked from registration.
+

+
Do DPML account holders need be current in the TMCH?
+
Yes. The trademark should remain current in the TMCH throughout the life of the DPML block. Donuts may elect to remove a DPML block for certain domains if the corresponding mark is not kept current in the TMCH.
+

+
'''Are there character limitations?'''
+
One and two character DPML terms are not permitted. Three character DPML terms are permitted but only as an exact match of the trademark.
+

+

You can access a general overview (history) of your DPML block creations by going to Manage Products / Domain Block / List Domain Blocks. Please note: all successful DPML block creation requests lead to a regular domain with the extension '.dpml.zone'. The domain will be visible in the domain list about 10 minutes after the successful DPML block creation. The contact details, creation date, expiration date can be reviewed in the domain list. The DPML block can basically be updated and renewed like a domain.

<!-- ===When a domain that is already blocked by a DPML, will override fees + registration fees be charged?===
+

+
The override fee is the same cost as the sunrise participation fee, so you can think of it as an everlasting sunrise for SMD holders.
+

+
===Is there any notification that an override fee is going to be charged?===
+

+
The amount of the override fee is in the domain:check command. If a registrar submits a valid SMD file at any time (during sunrise or after), and that name is blocked by a DPML, the registrar will be notified that an override fee will occur, and that registrar has to accept the fee before the override can occur (domain registration is completed). If the registrar accepts the fee and proceeds with a registration, they will be charged an override fee. but they will have a warning.
+

+
===Are override fees charged during a sunrise registration?===
+

+
During Sunrise, registrars are already obliged to submit a SMD file so if someone has already blocked a domain through a DPML, will they be charged an override fee along with the sunrise participation fee?
+

+
No override fee occurs during sunrise. If you have a valid SMD and use it during the sunrise phase you only pay the Sunrise Participation Fee (which happens to be the same amount as the override fee).
+

+
===What are the restore fees of a DPML block? Does it include a 1-year renewal? ===
+

+
If the block is restored during the regular lifecycle of the Restore-Grace-Period, the fee is $40 plus a one-year renewal, just like a domain name. If the block is not restored inside the RGP, regular prices apply for a "new" block.
+

+
+
===You say we should warn our client if he request a DPML on a premium name (the block will not be valid). Will Donuts provide a list of premium names?===
+

+
Yes, Donuts will provide to Registrars a list of all premium names as soon as those lists are complete. As a guideline, generally, the terms on the premium list will be generic terms. For example we will not put "BMW" on the premium list.

== DPML Block Override ==
+

+
When a trademark holder has a valid SMD file for a label block via a DMPL, are DPML override is used to register the exact string associated with the valid SMD file. For example, registering "bugatti.international" when there is a DPML block on "bugatti". The rules for DPML Block Overrise are as follows:
+

+
* The SMD file must exactly match of the registering label
+
* The domain name must not already be registered
+
* Anyone with a valid SMD file can override any matching domain. This is not limited to the one that created the DPML block in the first place
+
* A CheckDomain command will show 'not available'
+
* Charges for are similar to Sunrise application pricing and must be ordered similar to sunrise registration
+
* Only TLDs from the DONUTS and RIGHTSIDE registries support DPML blocks
+
* In addition to the valid SMD file, acceptance of the claims notice is required
+

See DPML Block Override API commands in the API Documentation.

[edit] How Does EAP Service Work

The EAP process was first pioneered by Donuts and is now used by a number of other registries like Google Registry. The program involves a number of consecutive days, typically seven (7), in which there is a set price for a domain name on each of the days. The price drops on each consecutive day until the 5th, 6th and 7th day, where the price remains the same. The set price for each day depends on the domain name and typically a grouping determined by the registry. Here is an example:

 • EAP1 (Day 1) 10,000 USD
 • EAP2 (Day 2) 5,000 USD
 • EAP3 (Day 3) 1,500 USD
 • EAP4 (Day 4) 500 USD
 • EAP5 (Day 5) 100 USD
 • EAP6 (Day 6) 100 USD
 • EAP7 (Day 7) 100 USD

Purchase of a domain during the EAP phase is First-Come, First-Served. The premium price paid by a registrant is typically only one-time and the domain name is renewed at regular standard prices. This one-time pricing model may change at anytime and may depend on the registry running the EAP program.

How can I submit a Preorder for an domain for an EAP phase?

At least 72 hours prior to a domain's EAP phase release date, using the Control Panel or API, a submission for the respective domain can be made. Please ensure that your account has sufficient funds to cover the cost of the registration, otherwise, the HEXONET system will not process the preorder request.

What if I have a Preorder for EAP4 (Day 4) but someone else registers the domain on EAP1 or EAP2 or EAP3?

All domain registrations during the EAP period are first-come, first-served. Once a domain is registered, all subsequent EAP dates are no longer valid. Refunds will automatically be processed.

What happens if no one registers a domain during the EAP period?

If a domain remains open and is not registered by anyone during the EAP period, the domain will be made available during General Availability, which immediately follows EAP.

Are all EAP periods for seven days?

Some registries have longer EAP periods. Some also have more than five price levels. Both the EAP periods and prices are dependent on the respective registry operating the EAP.
